Distance Contract
For Sale and Delivery of Goods

Desmo Baltija Sia, registration No. 40003592459, legal address: Kalnciema street 32a, Riga, LV-1083, Latvia, on the one hand, hereinafter referred to as the Seller, and a person (natural or legal) who places an order in the online store www.red9.lv and has confirmed that they have read and agree to the terms of this Distance Contract, hereinafter referred to as the Buyer, on the other hand, conclude the following Agreement:
1. Subject of the Agreement
1.1 The Seller sells and delivers electronic devices, hereinafter referred to as Goods, and the Buyer undertakes to accept and pay for the Goods in accordance with the terms of this Agreement.
1.2. The ordering of Goods shall be considered as the Buyer's offer to the Seller to conclude this Distance Contract and the Buyer's consent to purchase the ordered Goods at the indicated price, as determined according to the price list available on the ducati.lv website, depending on the chosen delivery method.
2. Procedure for Ordering and Delivery of Goods
2.1. The Goods are ordered by the Buyer by filling in the relevant order form in the online store ducati.lv. When placing the order, the Buyer undertakes to provide accurate information, i.e., the buyer's name, registration number and other required details if the buyer is a legal entity, or personal data and contact information if the buyer is a natural person. For any changes, the Buyer undertakes to notify the Seller no later than within 24 hours from the moment of receiving the order confirmation by writing to e-mail: shop@red9.lv. The Buyer is responsible for providing correct data; otherwise, delivery of the Goods is not guaranteed.
2.2. At the same time as placing an order for the purchase of Goods, the Buyer chooses the preferred method of receiving the Goods:
2.2.1. free of charge – the ordered goods are collected by the Buyer at the Seller’s office at the address: Mangaļu prospekts 47, Riga, LV-1030, Latvia, during working hours, after calling in advance tel.: +37129455773
2.2.2. for a fee – to the address indicated in the Buyer's order via SIA “Velokurjers” (hereinafter bike courier), SIA “TNT Latvia” and SIA DPD Latvia (hereinafter courier service).
2.3. The online store ducati.lv reserves the right not to process the order if its customer service specialists are unable to contact the Buyer using the provided phone number or e-mail.
2.4. Goods are handed over and/or delivered only after full payment of the invoice amount into SIA “Desmo Baltija” bank account. If the Buyer has not made the prepayment within 3 (three) days from the date of the prepayment invoice being sent, the purchase order is cancelled.
2.5. If the order and payment are made during working hours between 9:00 and 12:00, the Goods are handed over and/or delivered to the Buyer:
2.5.1. on the next working day at the Seller’s showroom at the address: Mangaļu prospekts 47, Riga, LV-1030, Latvia, during working hours, after calling in advance tel.: 29455773, if the Buyer chose the free collection option;
2.5.2. on the next working day by bike courier if the delivery address is within Riga, or by next working day courier service if the delivery is outside Riga (throughout Latvia) (delivery depends on the type of courier and its internal rules).
2.6. The Buyer accepts the Goods by checking their quality and quantity in the presence of the courier or the online store’s customer service specialist. The Buyer confirms the compliance of the Goods with the Delivery Note by signing the Delivery Note. If the Seller is unable to provide a Delivery Note at the time of delivery and/or handover, the signature for receipt of the shipment serves as confirmation.
2.7. If upon delivery it is found that the type, quantity, or quality of the delivered Goods does not match the purchase order, the Buyer must immediately contact the Seller and inform about the deficiencies in delivery.
3. Payments and Settlement Procedure
3.1. In the online store www.red9.lv, Goods prices are indicated in euros, excluding VAT. The full purchase amount, including VAT and delivery costs, if chosen by the Buyer, is indicated in the order confirmation or prepayment invoice and the Delivery Note.
3.2. The Seller has the right to adjust prices if the VAT rate or the value of the Goods changes.
3.3. Payment for the ordered Goods and selected delivery service can be made by bank transfer – after the order confirmation, a prepayment invoice will be sent to the e-mail address indicated in the order by a ducati.lv customer service specialist. When making the payment, the prepayment invoice number must be indicated.
4. Right of Withdrawal
4.1. The Buyer, a natural person, may exercise the right of withdrawal provided for in the Consumer Rights Protection Law of the Republic of Latvia and withdraw from the contract within 14 calendar days and return the goods purchased in the online store to the Seller. The withdrawal period ends on the 15th (fifteenth) day from the conclusion of the contract. If the last day of the period falls on an officially designated public holiday, the right of withdrawal may be exercised until the next working day (inclusive).
4.2. When the Buyer withdraws within the term specified in clause 4.1., the Buyer is responsible for maintaining the quality and safety of the Goods during the withdrawal period. The Buyer must keep the original packaging so that the Goods are not mechanically damaged when exercising the right of withdrawal.
4.3. To arrange the return of Goods, the Buyer must inform SIA “Desmo Baltija” of the decision to withdraw from the contract by sending an unequivocal notice by mail or e-mail with a withdrawal form.
4.4. To comply with the withdrawal period, it is sufficient if the Buyer sends their notice of exercising the right of withdrawal to SIA “Desmo Baltija” before the end of the withdrawal period.
4.5. If the Buyer withdraws from this contract within the period specified in clause 4.1., SIA “Desmo Baltija” will refund all payments received from the Buyer without undue delay and in any case not later than 14 days from the day SIA “Desmo Baltija” was informed of the Buyer’s decision to withdraw from the Distance Contract and the Goods have been received by SIA “Desmo Baltija”. SIA “Desmo Baltija” has the right to withhold reimbursement until the Goods (without defects and shortcomings) are returned to SIA “Desmo Baltija”.
4.6. The Buyer may not exercise the right of withdrawal in the following cases:
4.6.1. if the returned goods are damaged or not returned in full set;
4.6.2. if the Buyer has opened the product packaging, thereby causing it to lose its value, properties, or quality;
4.6.3. if the goods were used contrary to the technical specifications, the consumer loses the warranty for the goods;
4.6.4. if the goods are made to the buyer’s specifications, including a custom order.
4.7. The Buyer must return the Goods to SIA “Desmo Baltija” showroom at the address: Mangaļu prospekts 47, Riga, LV-1030, Latvia, during working hours, after calling in advance tel.: 29455773, without undue delay and in any case not later than 14 days from the day the Buyer informed SIA “Desmo Baltija” of their decision to withdraw from the Distance Contract. The period will be met if the Buyer sends the goods back before the end of the 14-day period.
4.8. SIA “Desmo Baltija” accepts returned Goods from the Buyer if they have not been used. The Buyer covers the return costs.
4.9. The right of return applies only to contracts concluded with natural persons – when the Buyer is a private individual and not a merchant. It does not apply in cases where goods are purchased by legal entities.
5. Warranty
5.1. All Goods purchased on ducati.lv have the manufacturer’s warranty and expiration dates.
5.2. The manufacturer’s warranty period for Goods may differ. Information about the warranty period can be found in the product description or, if not provided, from ducati.lv representatives.
5.3. If the manufacturer has set a warranty period shorter than two years for a particular Good, the Buyer has the right within two years from the purchase date to submit a claim regarding non-compliance with the terms of the contract. The right to submit a claim is valid if the goods have only been used under intended conditions and only in a household.
5.4. For legal entities and merchants, only the manufacturer’s warranty period applies.
5.5. The manufacturer’s warranty conditions apply if the Buyer can present:
5.5.1. proof of purchase (bank payment, delivery note);
5.5.2. manufacturer’s or distributor’s warranty card (if included in the product package).
5.6. Warranty conditions do not apply to mechanically wearing parts and additional accessories (e.g., product accessories), power supply elements (e.g., batteries, accumulators), or items with limited lifespan (e.g., fuses).
5.7. Warranty conditions do not apply to damages caused by the Buyer or user if the Goods were not used for their intended purpose and not operated as specified in the user manual.
6. Other Terms
6.1. This Agreement is drafted electronically and valid without signature.
6.2. The Agreement enters into force once the Buyer has placed an order via internet, phone, or other means and has received confirmation of the order from the Seller by e-mail.
6.3. The financial information of the Agreement is confidential except for the provisions of clause 3.1.
6.4. This Agreement is binding on SIA “Desmo Baltija”, the Buyer, and all their successors of rights and obligations.
