RIGHT OF WITHDRAWAL AND PRODUCT RETURNS

1. Right of Withdrawal

If a product is purchased through the RED9.lv online store, the Consumer has the right to withdraw from the distance contract within 14 days from the date of receipt of the product, without providing any reason for doing so.

If several products purchased in one order are delivered separately, the withdrawal period shall be calculated from the date on which the last product is received.

The right of withdrawal also applies to products purchased at a discount or during a sale.

The right of withdrawal applies to Consumers – natural persons who purchase products for purposes unrelated to their business or professional activities.

2. How to Exercise the Right of Withdrawal

To exercise the right of withdrawal, the Consumer must submit an unequivocal statement to the Seller declaring their decision to withdraw from the distance contract.

This can be done by:

• Using the “Withdraw from Contract” function available in the RED9.lv online store.

• Sending a withdrawal notice by email to: shop@red9.lv.

• Sending a written notice to the registered legal address of SIA “Desmo Baltija”: Kalnciema iela 32A, Riga, LV-1083, Latvia.

The withdrawal deadline is met if the withdrawal notice is sent before the expiry of the 14-day period.

After submitting the withdrawal notice, the product must be sent or delivered to the Seller within 14 days.

If the Consumer uses the withdrawal function available in the online store, a confirmation of receipt of the withdrawal notice will be sent to the email address provided by the Consumer. The confirmation will specify the content of the submitted notice, as well as the date and time of submission.

3. Conditions for Returning Products

The Consumer has the right to inspect and examine the product to the extent that would be permitted in a regular physical store.

The product must be returned together with its accessories and any documents included in the package, where applicable.

If the Consumer has used or handled the product beyond what is necessary to establish its nature, characteristics and functioning, the Consumer shall be liable for any reduction in the value of the product in accordance with applicable laws and regulations.

Opening the product packaging alone shall not constitute grounds for denying the right of withdrawal.

4. Product Return Costs

The direct costs of returning the product shall be borne by the Consumer, provided that the Seller informed the Consumer of this obligation before the distance contract was concluded and has not agreed to cover these costs.

If the Seller did not inform the Consumer of the obligation to bear the product return costs before the contract was concluded, these costs shall be borne by the Seller.

5. Refund Procedure

Following receipt of the withdrawal notice, the Seller shall refund all payments received from the Consumer, including the costs of standard delivery.

If the Consumer chose a more expensive delivery method than the least expensive standard delivery method offered by the Seller, the additional delivery costs shall not be refunded.

The refund shall be made no later than 14 days from the date on which the Seller received the Consumer's withdrawal notice.

The Seller has the right to withhold the refund until the returned product has been received or until the Consumer has provided proof that the product has been sent back, whichever occurs first.

The refund shall be made using the same payment method that the Consumer used for the original transaction, unless the Consumer has expressly agreed to a different refund method. No additional fees shall be charged for the refund.

6. Cases in Which the Right of Withdrawal Cannot Be Exercised

Applicable laws and regulations specify certain exceptions in which the right of withdrawal does not apply.

Examples include:

• Products manufactured according to the Consumer's individual specifications or clearly personalised.

• Products that are liable to deteriorate or expire rapidly.

• Sealed products which are not suitable for return for health protection or hygiene reasons and whose packaging has been opened after delivery, provided that the statutory exception applies to the particular product.

These exceptions apply only in the cases specified by applicable laws and regulations. They do not automatically apply to all motorcycle spare parts and accessories.

7. Where to Send or Deliver Returned Products

Returned products may be sent or delivered to the following address:

Please include the order number or invoice number with the returned product so that the purchase can be identified.

Proof of purchase may include an invoice, delivery note, order confirmation or any other document confirming the transaction.

We recommend contacting the Seller in advance to agree on the most convenient method of returning the product. However, prior contact is not a mandatory requirement for exercising the right of withdrawal or submitting a withdrawal notice.

8. Withdrawal Form

The Consumer may use the sample withdrawal form provided below, but its use is not mandatory. The Consumer may also submit any other unequivocal statement declaring their decision to withdraw from the distance contract.
