Distance Contract

For the Sale and Delivery of Goods

Desmo Baltija Sia, registration No. 40003592459, on the one hand, hereinafter referred to as – Seller, and a person (natural or legal), who places an order in the online store www.red9.lv and has confirmed that they have read and agree to this Distance Contract, hereinafter – Contract, terms, hereinafter referred to as Buyer, on the other hand, conclude the following Contract:

1. Subject of the Contract
1.1 The Seller sells and delivers electronic devices, hereinafter referred to as Goods, and the Buyer undertakes to accept and pay for the Goods in accordance with this Contract.
1.2. Ordering the Goods shall be considered as the Buyer’s offer to the Seller to conclude this Distance Contract and the Buyer’s consent to purchase the ordered Goods at the indicated price, as set according to the price list available on red9.lv website, depending on the chosen delivery method.

2. Procedure for Ordering, Acceptance and Delivery of Goods
2.1. The Buyer orders the Goods by filling in the relevant order form in the online store red9.lv. When placing an order, the Buyer undertakes to provide accurate information, i.e., the buyer’s name, registration number and other required details if the buyer is a legal person, or personal data and contact information if the buyer is a natural person. For any changes, the Buyer undertakes to inform the Seller no later than 24 hours from receiving the order confirmation by writing to e-mail: shop @ red9 . lv. The Buyer is responsible for providing correct data; otherwise, delivery of the Goods is not guaranteed.
2.2. At the time of ordering, the Buyer chooses the preferred method of receiving the Goods:
2.2.1.free of charge – the ordered Goods are collected at the Seller’s office at Mangaļu prospekts 43, Riga, LV-1030, Latvia, during working hours, by prior arrangement via phone: 29455773
2.2.2. for a fee – delivered to the Buyer’s indicated address via SIA Omniva or SIA DHL.
2.3. The online store red9.lv reserves the right not to process the order if customer service specialists cannot contact the Buyer via the provided phone number or e-mail.
2.4. Delivery or collection of the Goods is carried out only after full payment of the invoice amount into the account of SIA „Desmo Baltija”. If the Buyer has not paid the advance invoice within 3 (three) days from the date of issue, the order shall be cancelled.
2.5. If the Goods are ordered and paid for by 12:00 during working hours, the Goods will be issued and/or delivered to the Buyer:
2.5.1. on the same working day at the Seller’s store at Mangaļu prospekts 43, Riga, LV-1030, Latvia, upon prior confirmation by phone that the order has been prepared. For information on the order status and contents, please call in advance: 29455773, if the Buyer has chosen free collection;
2.5.2. delivery via Omniva parcel machine, throughout Latvia, depending on the supplier’s terms, usually within 1–3 working days.
2.6.  The Buyer accepts the Goods by checking their quality and quantity in the presence of the courier or customer service specialist. The Buyer confirms compliance with the invoice by signing it. If the invoice cannot be issued upon delivery, the shipment receipt signature serves as proof of delivery.
2.7. If upon delivery it is found that the type, quantity, or quality of Goods does not comply with the order, the Buyer shall immediately inform the Seller about the discrepancies.

3. Payments and Settlement Procedure
3.1. Prices of Goods in the online store red9.lv are indicated in euros including VAT, with the price without VAT also displayed. The total purchase price, including VAT and delivery costs (if selected), is indicated in the order confirmation or advance invoice and delivery note.
3.2. The Seller has the right to adjust prices if the VAT rate or the value of the Goods changes. For oversized items, the Seller has the right to adjust transport costs.
3.3. Payment for ordered Goods and delivery services can be made by bank transfer – after order confirmation, the red9.lv customer service specialist will send the advance invoice to the e-mail provided. When making the payment, the advance invoice number must be indicated.

4. Right of Withdrawal
4.1. The Buyer, a natural person, may exercise the right of withdrawal under the Consumer Rights Protection Law of the Republic of Latvia and withdraw from the contract within 14 calendar days, returning the purchased Goods to the Seller. The withdrawal period ends on the 15th day from the date of contract conclusion. If the last day falls on an official holiday, the period is extended to the following working day.
4.2. When exercising the right of withdrawal, the Buyer is responsible for maintaining the quality and safety of the Goods during the withdrawal period. The original packaging must be preserved to prevent damage.
4.3. To arrange a return, the Buyer must inform SIA „Desmo Baltija” of the decision by sending a withdrawal form via post or e-mail.
4.4. The deadline is met if the notice is sent before the withdrawal period ends.
4.5. In case of withdrawal, SIA „Desmo Baltija” shall refund all received payments without undue delay, but no later than 14 days after being informed of the Buyer’s decision, and once the Goods have been returned to SIA „Desmo Baltija”. The Seller has the right to withhold the refund until the Goods are received in proper condition.
4.6. The Buyer may not exercise the right of withdrawal in the following cases:
4.6.1. if the returned Goods are damaged or incomplete;
4.6.2. if the Buyer has opened the packaging, thereby losing its value, properties, or quality;
4.6.3. if the Goods have been used contrary to technical specifications (warranty is void);
4.6.4. if the Goods were custom-made to the Buyer’s specifications.
4.7. The Goods must be returned to SIA „Desmo Baltija” showroom at Mangaļu prospekts 43, Riga, LV-1030, Latvia, during working hours, by prior arrangement via phone: 29455773, without undue delay, but no later than 14 days after notifying the Seller of withdrawal. The deadline is met if the Goods are sent before the 14-day period expires.
4.8. SIA „Desmo Baltija” accepts only unused Goods. The Buyer bears the return costs.
4.9. The right of withdrawal applies only to natural persons (consumers) and does not apply to purchases made by legal entities.

5. Warranty
5.1. All Goods purchased on red9 .lv have the manufacturer’s warranty and expiry terms.
5.2. The warranty period differs depending on the product. Information is available in the product description or from ducati.lv representatives if not specified.
5.3. If the manufacturer sets a warranty shorter than two years, the Buyer still has the right to claim non-compliance within two years from purchase, provided the Goods were used only under intended household conditions.
5.4. For legal entities, only the manufacturer’s warranty applies.
5.5. The warranty applies if the Buyer can present:
5.5.1. proof of purchase (bank payment, delivery note);
5.5.2. the manufacturer’s or distributor’s warranty card (if provided).
5.6. The warranty does not cover consumable parts (e.g., accessories, batteries, fuses).
5.7. The warranty does not apply to damage caused by misuse, failure to follow instructions, or use outside intended purposes.

6. Other Provisions
6.1. This Contract is drawn up electronically and valid without a signature.
6.2. The Contract comes into force once the Buyer places an order online, by phone, or otherwise, and receives order confirmation by e-mail.
6.3. Financial information of the Contract is confidential, except as stated in clause 3.1.
6.4. This Contract is binding on SIA „Desmo Baltija”, the Buyer, and their successors in rights and obligations.
